law on volunteers replacing paid staff

    Hi all,

    I know that volunteers can't take the place of a paid staff person and that two people cannot be doing the exact same job -one paid and one unpaid. My supervisor is asking me to locate that law and provide it to her.  Do any of you have access to the actual law that states such?

    That is in the Fair Labor Standards Act

    Hi Patty,

    Legal and HR have been great partners when I want to explain to leadership that volunteers can't replace staff. Labor Laws have confusing language and lots of grey areas from what I've been able to find. Having legal and HR clearly delineate what they view as acceptable/ not acceptable for volunteers has helped me to share the information without getting as much push back from leadership.
